The Fun Frame – Event Services Terms & Conditions

These Terms & Conditions apply to all event services provided by The Fun Frame LLC (“The Fun Frame,” “we,” “us,” or “our”), including photo booth rentals, photography services, and related equipment and staffing.

By booking our services, submitting a payment, or allowing us to perform services at your event, you agree to the following terms.

1. Services Provided

The Fun Frame provides event-based photo booth and/or photography services as described in your proposal or service agreement. Services are provided for the specific date, time, and location listed in your booking confirmation.

Any online forms, galleries, or communication tools are provided for convenience and do not replace the event agreement.

2. Booking, Deposits & Payments

• A signed agreement and required retainer (deposit) are needed to secure your event date.

• Event dates are not reserved until payment and agreement are received.

• Retainers are non-refundable, as dates are removed from availability once booked.

• Remaining balances must be paid by the deadline stated in your proposal.

• Late or failed payments may result in suspension or cancellation of services.

3. Cancellations & Rescheduling

• If you cancel your event, payments already made are non-refundable.

• Rescheduling requests are subject to availability and must be approved in writing.

• If we are unable to rebook your original date, your retainer remains non-refundable.

• If The Fun Frame must cancel due to illness, emergency, or circumstances beyond our control, liability is limited to a refund of payments made.

4. Force Majeure (Events Beyond Control)

We are not liable for failure or delay in performance due to events beyond our control, including but not limited to:

• Severe weather

• Power or internet outages

• Venue restrictions or shutdowns

• Acts of God, fire, flood, strikes, or government orders

In such cases, liability is limited to amounts paid.

5. Event Conditions & Venue Requirements

You are responsible for ensuring:

• Adequate space, power, and access at the venue

• Safe and reasonable conditions for equipment and staff

• Compliance with venue rules and permissions

We are not responsible for service interruptions caused by venue limitations, power loss, internet issues, or guest interference.

6. Guest Conduct & Equipment Damage

Guests must use equipment as instructed.

You agree to be financially responsible for:

• Damage caused by guests

• Misuse, spills, or physical interference with equipment

• Theft or vandalism during the event

Repair or replacement costs may be charged to the client.

7. No Guarantee of Specific Shots or Outcomes

While we strive to deliver a great experience:

• We do not guarantee specific poses, expressions, participation levels, or guest behavior.

• Equipment issues, lighting conditions, or guest actions may affect results.

• Minor imperfections do not constitute service failure.

8. Image Delivery & Style

• Photo delivery timelines are provided in your proposal.

• Editing style and presentation are based on our professional judgment.

• Raw files are not provided unless explicitly agreed upon in writing.

9. Photo & Video Usage Rights (Important)

You retain personal use rights to your event photos.

By booking our services, you grant The Fun Frame permission to use select images for:

• Portfolio

• Website

• Social media

• Marketing and promotional purposes

If your event requires no promotional use, you must notify us in writing prior to the event.

10. Minors & Parental Responsibility

Clients are responsible for obtaining consent from parents or guardians for minors photographed at private events.

We are not responsible for guest consent disputes unless explicitly contracted otherwise.

11. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claim is limited to the amount paid for services.

• We are not liable for indirect, incidental, or consequential damages.

• We are not responsible for missed moments due to circumstances beyond our control.

12. Communication & Consent

By submitting an inquiry or booking services, you consent to communication via text, email, or phone regarding your event.

Message and data rates may apply. You may opt out of text messages at any time.

13. Dispute Resolution & Governing Law

Any dispute arising from our services shall be resolved through binding arbitration under Alabama law.

Venue and jurisdiction shall be Alabama.
Both parties waive the right to a jury trial.

14. Entire Agreement

These Terms & Conditions, together with your proposal and invoice, constitute the entire agreement between you and The Fun Frame.

No verbal agreements or promises are binding unless confirmed in writing.
